Acceptance of Terms
By accessing or using the MBHS website, platform, or services, you agree to be bound by these Terms of Service. If you do not agree, please do not use MBHS.
1. Service Description
What We Provide
- •B2C: Individual access to the MBHS mental health screening assessment and results
- •B2B: Professional platform for therapists and practice managers to administer and review screenings
- •Automated scoring and percentile ranking across behavioral health scales
- •Suicide risk classification based on validated screening algorithms
- •PDF report generation for clinical documentation
- •Progress tracking and historical screening data
What We Do Not Do
- •Provide medical diagnoses or clinical assessments
- •Offer therapy, counseling, or treatment services
- •Replace the clinical judgment of licensed mental health professionals
- •Provide emergency services or crisis intervention
- •Guarantee specific treatment outcomes or results
2. User Accounts
Account Registration
- •You must provide accurate, current, and complete information during registration
- •You are responsible for maintaining the confidentiality of your account credentials
- •You must notify us immediately of any unauthorized use of your account
- •You are responsible for all activities that occur under your account
Account Eligibility
- •Individual users must be 18 years of age or older
- •B2B (therapist/practice manager) accounts require valid professional licensure
- •Use of the platform is void where prohibited by law
Account Termination
- •We reserve the right to suspend or terminate accounts that violate these Terms
- •You may close your account at any time by contacting support@mbhs.com
- •Upon termination, your access to the platform will be revoked
- •Data retention after termination is governed by our Privacy Policy
3. Payment Terms
B2C (Individual) Payments
- •Payment is required before accessing individual assessment services
- •All prices are listed in USD and are subject to change
- •Purchases are non-refundable once the assessment has been accessed
- •See our Refund Policy for details on eligible refund situations
B2B (Therapist) Subscriptions
- •Subscriptions are billed on a recurring monthly or annual basis
- •Subscriptions automatically renew unless cancelled before the renewal date
- •You may cancel your subscription at any time via Account Settings
- •Access continues until the end of the current billing period after cancellation
Payment Processing
- •All payments are processed securely through our third-party payment processor
- •We do not store your full credit card information
- •You are responsible for any applicable taxes in your jurisdiction
- •Failed payments may result in temporary suspension of your account
4. User Conduct
Prohibited Actions
- •Using the platform for any unlawful purpose or in violation of any regulations
- •Attempting to gain unauthorized access to any part of the platform
- •Reverse engineering, decompiling, or disassembling any part of the platform
- •Uploading or transmitting viruses or any malicious code
- •Impersonating any person or entity or misrepresenting your affiliation
- •Collecting or harvesting user data without authorization
- •Using the platform to send unsolicited communications
- •Interfering with or disrupting the integrity or performance of the platform
Professional Standards (B2B)
- •Therapists must use the platform in accordance with their professional licensure and ethical guidelines
- •You are responsible for obtaining informed consent from clients before administering screenings
- •MBHS results must be interpreted as part of a comprehensive clinical evaluation
- •You must maintain appropriate records and confidentiality as required by law
- •You are solely responsible for clinical decisions made based on screening results
5. Intellectual Property
Ownership
- •All content, features, and functionality of the MBHS platform are owned by MBHS and protected by copyright, trademark, and other laws
- •The MBHS assessment instrument, scoring algorithms, and normative data are proprietary
- •You may not reproduce, distribute, or create derivative works without written permission
Limited License
- •We grant you a limited, non-exclusive, non-transferable license to access and use the platform
- •This license is for your personal or professional use only
- •The license does not include the right to sublicense or resell access to the platform
Your Data
- •You retain ownership of the data you input into the platform
- •By using the platform, you grant us a limited license to process your data to provide the service
- •We will not sell your personal or clinical data to third parties
6. Confidentiality and Privacy
Data Security
- •We implement industry-standard security measures to protect your data
- •All data is encrypted in transit and at rest
- •Access to user data is restricted to authorized personnel only
- •We conduct regular security audits and vulnerability assessments
HIPAA Compliance
- •For B2B users, we operate as a Business Associate under HIPAA regulations
- •We will sign a Business Associate Agreement (BAA) with qualifying healthcare providers upon request
- •Protected Health Information (PHI) is handled in accordance with HIPAA requirements
7. Disclaimers and Limitations
Service Availability
- •We strive for 99.9% uptime but do not guarantee uninterrupted service
- •Scheduled maintenance may temporarily affect platform availability
- •We are not liable for losses resulting from service interruptions beyond our control
- •We reserve the right to modify or discontinue features with reasonable notice
Clinical Limitations
- •MBHS is a screening tool only and does not constitute a clinical diagnosis
- •Screening results should be interpreted in the context of a full clinical evaluation
- •We are not responsible for clinical decisions made based on screening results
- •The tool is not validated for use with individuals under 18 years of age
Limitation of Liability
- •To the fullest extent permitted by law, MBHS shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- •Our total liability for any claim shall not exceed the amount paid by you in the 12 months preceding the claim
- •We are not liable for any harm resulting from reliance on screening results without professional consultation
- •We are not responsible for third-party services or links accessed through the platform
- •Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you
8. Indemnification
You agree to indemnify, defend, and hold harmless MBHS and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from:
- •Your use of the platform in violation of these Terms
- •Your violation of any applicable law or regulation
- •Your infringement of any third-party rights
- •Any clinical decisions or actions taken based on screening results
9. Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law provisions.
Arbitration
- •Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association
- •Arbitration shall take place in San Francisco, California, unless otherwise agreed
- •You waive your right to participate in class action lawsuits related to these Terms
10. Changes to Terms
- •We reserve the right to modify these Terms at any time
- •Changes will be posted on this page with an updated effective date
- •For material changes, we will provide notice via email or prominent notice on the platform
- •Continued use of the platform after changes constitutes acceptance of the revised Terms

12. Miscellaneous
